1 Agreement to these terms

These Terms of Service (the "Terms") apply to your use of junkcarswithus.com (the "Site") and to any vehicle you sell to Junk Cars With Us ("we," "us" or "our").

By using the Site, calling or texting us, requesting an offer or selling us a vehicle, you agree to these Terms. If you don't agree, please don't use the Site or our services.

2 What we do

We buy junk, wrecked, non-running, old and unwanted vehicles, and we tow the vehicles we buy from locations within our service area, generally Tampa and about 30 miles around it.

Information on the Site is for general information only. It isn't legal, tax or title advice. Rules for titles, plates and vehicle transfers are set by the State of Florida and can change, so check with your county tax collector or the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) for your situation.

3 Offers and pricing

Offers we give by phone, text or online are based on the information you provide, including year, make, model, condition, location and whether parts such as the engine, transmission, catalytic converter or wheels are present.

An offer is an estimate until we inspect the vehicle at pickup. If the vehicle doesn't match what was described, for example missing parts, different damage or a different vehicle, we may revise the offer or decline the purchase. You're free to decline a revised offer.

Offers may expire. Scrap and parts values change, so an offer is good only for the time we tell you.

4 Ownership and paperwork

Proof of ownership is always required. By selling us a vehicle you confirm that:

• You are the legal owner of the vehicle, or are legally authorized to sell it on the owner's behalf.
• The vehicle isn't stolen and isn't subject to any undisclosed lien, loan, lease or legal claim.
• All documents and identification you give us are genuine and accurate.

We'll ask for a valid government-issued photo ID and a title or other ownership documents. We may decline any purchase if we can't verify ownership. Some vehicles can't be bought without a title, and we'll tell you before pickup if that applies.

We may be required by law to record your identification and vehicle information and report vehicles we buy to state agencies and to the National Motor Vehicle Title Information System (NMVTIS). We cooperate with law enforcement and will report vehicles we believe are stolen.

5 Pickup and towing

Towing is free within our service area. You agree to give us safe, legal access to the vehicle. Tell us about anything that affects the tow before we arrive, such as flat tires, locked wheels, missing keys, gates, tight spaces or a vehicle stored at a tow yard or repair shop.

You, or someone you authorize who can show ID and sign the paperwork, should be present at pickup unless we agree otherwise in advance.

If we can't reach or safely tow the vehicle because of conditions you didn't tell us about, we may reschedule or cancel the pickup. We aren't responsible for storage, impound or yard fees owed to third parties unless we agree to cover them in writing.

6 Payment

We pay the agreed amount when the vehicle is picked up and the paperwork is signed, using the payment method we confirm with you before pickup.

Once you're paid and the vehicle and paperwork are handed over, the sale is final and ownership of the vehicle passes to us.

7 After the sale: your responsibilities

Before or at pickup, you're responsible for:

• Removing all personal belongings. We aren't responsible for items left in the vehicle.
• Removing your license plate. In Florida, plates stay with the owner, not the vehicle.
• Removing toll transponders such as SunPass from the vehicle and from your account.
• Cancelling insurance on the vehicle and completing any notice of sale or transfer the State of Florida requires.

8 Calls and text messages

When you call or text us, or give us your phone number, you agree that we may contact you by phone call and text message about your offer, pickup and sale. These are transactional messages, not marketing.

Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving texts and HELP for help. Consent to receive texts isn't a condition of selling us a vehicle. See our Privacy Policy for how we handle your phone number.

9 Using the Site

You agree not to misuse the Site, including by trying to disrupt it, gain unauthorized access, scrape it in bulk or submit false information.

The Site's content, including text, graphics and logos, belongs to Junk Cars With Us or its licensors and may not be copied for commercial use without permission. Links to other websites are provided for convenience. We don't control those sites and aren't responsible for them.

10 Disclaimers and limitation of liability

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT ALLOWED BY LAW.

TO THE FULLEST EXTENT ALLOWED BY LAW, JUNK CARS WITH US IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A VEHICLE PURCHASE WILL NOT EXCEED THE AMOUNT WE PAID OR AGREED TO PAY FOR THAT VEHICLE.

Nothing in these Terms limits any right you have that can't be limited under Florida law.

11 Your responsibility for claims

You agree to cover our losses, including reasonable attorneys' fees, if a third party makes a claim against us because information you gave us was false, including a claim that you didn't own or weren't authorized to sell a vehicle you sold us.

12 Governing law

These Terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Hillsborough County, Florida, unless the law requires otherwise.

13 Changes to these terms

We may update these Terms from time to time. The updated version takes effect when it's posted on this page with a new effective date. The Terms in effect when you sell us a vehicle apply to that sale.
